Statement from Latinos for a Fair Judiciary on All Republican-Appointed Fifth Circuit Court panel’s DACA decision

Washington, DC — Latinos for a Fair Judiciary (LFJ) denounces yesterday’s decision by a  Fifth Circuit Court of Appeals panel affirming the district court's ruling against the Deferred Action for Childhood Arrivals (DACA) program and remanding the case in light of a new regulation issued in August. The Fifth Circuit panel responsible for the opinion was composed of one judge appointed by former President George W. Bush and two judges appointed by former President Donald Trump.

In response to the decision, Andrea Nill Sanchez, Executive Director of Latinos for a Fair Judiciary, provided the following statement:

“Yesterday’s devastating ruling to strip thousands of Latinos of their right to work and live in the U.S. was decided by a circuit that has no Latino judges, despite the fact that nearly all DACA recipients were born in Latin America or the Caribbean. The decision reflects how a lack of representation in the judicial system negatively impacts Latino communities and further underscores the importance of having qualified, diverse judges who are well-versed in the everyday issues that the Latino community faces. Congress must focus its efforts on confirming the many outstanding Latinos who have been nominated to the federal bench in order to curb the lasting, harmful effects that a lack of diversity on the courts has on legal outcomes.”
