BeLatina: Federal Judge is Impeding Latino Judge From Filling His Seat

A group of renowned Latino leaders is outraged after learning U.S. District Judge David Hurd rescinded his senior status a day after Jorge Alberto Rodriguez was nominated. Due to this, Rodriguez won’t be able to fill the seat in the Northern District of New York.

This group is well-known for its advocacy, of civil, and legal rights in the Latino community and has experience in fighting against a system that has not always been fair to Latinos and other historically excluded communities. We are talking about Voto Latino, LatinoJustice PRLDEF, Mi Familia Vota, LULAC, Mexican American Legal Defense and Educational Fund, and Latinos for a Fair Judiciary. Their voices have rung through our community for years and, collectively, they’ve now authored a letter urging Hurd to reconsider his latest decision.

The Hill: Groups call on judge to clear way for first Latino on upstate New York court

A coalition of Latino advocacy groups on Monday called on an upstate New York federal district judge to move forward with his recently rescinded plans to retire, after President Biden nominated New York Assistant Attorney General Jorge Alberto Rodriguez for the post.

U.S. District Judge David Hurd had announced his retirement from active duty in November, seeking to take “senior status” pending confirmation of a successor.

ALBANY — A nationwide legal advocacy group for Latinos is slamming U.S. District Judge David N. Hurd’s reversal of his earlier plan to become a senior judge, saying the switch has improperly blocked the path of Clifton Park attorney Jorge Alberto Rodriguez to the federal bench.

Hurd, who is based in Utica, changed course after learning that President Joseph Biden's pick to replace him lived in the Capital Region.

That’s how a group of prominent Latino legal and civil rights leaders in an open letter on Monday described their reaction to U.S. District Judge David Hurd’s decision to rescind his plan to take senior status the day after Jorge Alberto Rodriguez was nominated to fill his seat in the Northern District of New York.

“We urge you to reconsider your decision to effectively block the appointment of Mr. Rodriguez — a highly qualified judicial candidate who would also make history as the first Latino judge to sit on an N.D.N.Y. court,” Latinos for a Fair Judiciary wrote in a letter that the authors shared in advance with me.
